The Regulation on the Amendment to the Regulation on Personal Health Data (the “Amending Regulation”) has been published in the Official Gazette dated 4 July 2026 and numbered 33300, and entered into force on the same date. The Amending Regulation introduces amendments to the Regulation on Personal Health Data (the “Regulation”) concerning the correction and reassessment of personal health data. The details of these amendments are set out below:
Correction of Personal Health Data
Under the Amending Regulation, it is stipulated that where health data has been created erroneously by the General Directorate of Health Information Systems, the correction process carried out in response to the relevant application will be limited to the database of the relevant healthcare provider. In addition, it is provided that whether the same correction should also be reflected in the databases of other institutions and organizations processing the same data will be assessed by the relevant institution or organization in accordance with the applicable legislation.
Reassessment of Personal Health Data
A new provision introduced to the Regulation allows previously established medical diagnoses to be reassessed based on an individual's current health condition. Accordingly, upon the application of the data subject, diagnoses will be reassessed either by a three-physician medical board or a fully constituted medical board, depending on the procedure under which the original diagnosis was made, and a medical board report indicating the individual's current health status will be issued. Where the reassessment concludes that the diagnosis no longer reflects the individual's current health condition, the newly issued medical board report, rather than the historical diagnosis, will serve as the basis for future administrative and legal procedures—including, in particular, pre-employment processes—unless otherwise provided under the applicable legislation.
